| Abstract: | ศึกษาวิเคราะห์ถึงปัญหาหรืออุปสรรคนการดำเนินการขอ การรับรองมาตรฐานความรับผิดชอบทางสังคม 8000 (SA 8000) ของสถานประกอบกิจการเพื่อการส่งออกในประเทศไทย เพราะข้อกำหนดในมาตรฐาน SA 8000 หลายประเด็นมีความไม่สอดคล้องกับพระราชบัญญัติคุ้มครองแรงงาน พ.ศ. 2541 พระราชบัญญัติแรงงานสัมพันธ์ พ.ศ. 2518 รวมถึงข้อกฎหมายหรือมาตรการที่เกี่ยวกับความปลอดภัย อาชีวอนามัย และสภาพแวดล้อมในการทำงาน และมุ่งศึกษาหามาตรการในการแก้ไขปัญหา และเสนอแนะแนวทางในการปรับปรุงกฎหมายแรงงานต่อไป จากการศึกษาพบว่า การที่มาตรฐาน SA 8000 ถูกกำหนดขึ้นโดยประเทศที่พัฒนาแล้ว มาตรฐานขึ้นต่ำจึงสูงเกินกว่าสถานประกอบกิจการในประเทศไทย ซึ่งเป็นประเทศกำลังพัฒนาจะพึงให้แก่ลูกจ้างได้ ทำให้นายจ้าง ลูกจ้าง และบุคคลที่เกี่ยวข้องในสถานประกอบกิจการ ต้องประสบกับปัญหาในการจัดทำมาตรฐานความรับผิดชอบทางสังคม 8000 ไม่ว่าจะเป็นปัญหาในทางปฏิบัติอันเกิดจากความไม่พร้อมของบุคลากร หรือสภาพแวดล้อมในสถานประกิจการ และปัญหาทางกฎหมายที่เกิดจาก ข้อกำหนดความรับผิดชอบทางสังคมในมาตรฐาน SA 8000 เรื่องแรงงานเด็ก แรงงานบังคับ เสรีภาพในการสมาคมและสิทธิในการร่วมเจรจาต่อรอง การลงโทษทางวินัย และชั่วโมงการทำงานล่วงเวลา ไม่สอดคล้องกับกฎหมายแรงงานที่ใช้บังคับอยู่ จึงควรปรับปรุงพระราชบัญญัติคุ้มครองแรงงาน พ.ศ. 2541 พระราชบัญญัติแรงงานสัมพันธ์ พ.ศ. 2518 และข้อกฎหมายที่เกี่ยวกับความปลอดภัย อาชีวอนามัยและสภาพแวดล้อมในการทำงาน บางประเด็นที่เกี่ยวกับการส่งเสริมการศึกษาของแรงงานซึ่งเป็นเด็กที่มีอายุต่ำกว่า 18 ปี การลดจำนวนชั่วโมงการทำงานล่วงเวลา เป็นต้น ที่สำคัญต้องมีการร่วมมือกันจากทุกส่วนในสังคม ไม่ว่าจะเป็นองค์กรภาครัฐ ภาคธุรกิจหรือเอกชน นายจ้าง ลูกจ้าง หรือบุคคลอื่นที่เกี่ยวข้อง |
| Other Abstract: | To study and analyze the problems of difficulties in applying for Social Accountability 8000 (SA 8000) Certification by export businesses in Thailand since many requirements in the SA 8000 are not in conformity with the Labour Protection Act, .B.E. 2541, Labour Relatiions Act, B.E. 2518 and other legal provisions or criteria relating to safety, occupational health and work environment, the objective of the study is also to find solutions to such problems or difficulties and to propose guidelines for an improvement of the labour laws. From the study, it is observed that since the SA 8000 was promulgated by developed countries, its minimum standard requirements tend to be higher employees than standards of the business operators in Thailand, which is a developing country. The creates problems in complying with Social Accountability 8000 faced by all employers, employees and other parties involved in the businesses. Problems can be due to non-readiness of the personnel or to the work environment. These could also be legal issue arising from the requirements of the SA 8000 with respect to child labour, forced labour, freedom of association and right to collective bargaining, disciplinary practices and overtime working fours which may not be in conformity with the requirement of the labour laws. There should be an amendment to certain the Labour Protectiion Act, B.E. 2541, Labour Relations Act, B.E. 2518 and legal provisions relating to safety, occupational health and work environment. Study support should be provided for labour under 18 years of age, reduction of overtime work hours and etc. More importantly, cooperation from all sectors in society is of critical importance, namely between governmental organizations, business or private sectors, employees and other related persons. |
